In compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), its Regulations, and the Privacy Notice Guidelines published in the Official Gazette of the Federation, Arko makes this Privacy Notice available to you.

Meta Ads forms (Facebook and Instagram): When you interact with our ads and provide your data through the forms integrated into Meta's platforms.

V. Transfer of Personal Data

Your personal data may be transferred to the following third parties, for the indicated purposes:

Technology service providers: Cloud storage, database management (CRM), form processing, and communication tools necessary for the operation of the business. For the purpose of receiving, storing, and following up on the requests submitted through the Site.
Meta Platforms, Inc.: Management of advertising campaigns, measurement of results, and optimization of ads. Data is processed in accordance with Meta's privacy policy.
Competent authorities: When required by law, judicial resolution, or request of a competent authority.

We inform you that for the indicated transfers that require your consent, by providing your personal data you consent to such transfers. Transfers to competent authorities do not require your consent in accordance with Article 37 of the LFPDPPP.

VI. ARCO Rights

You have the right to know what personal data we hold about you, what we use it for, and the conditions of the use we give it (Access). Likewise, it is your right to request the correction of your personal information when it is outdated, inaccurate, or incomplete (Rectification); to have it removed from our records or databases when you consider that it is not being used appropriately (Cancellation); as well as to oppose the use of your personal data for specific purposes (Opposition). These rights are known as ARCO rights.

To exercise any of the ARCO rights, you must submit a request (the "ARCO Request") to Arko's data protection department through the email privacidad@arkomkt.com, which must contain the following information:

Full name of the data owner.
A clear and precise description of the personal data in respect of which you seek to exercise any of the ARCO rights.
Any document or information that facilitates the location of your personal data.
A copy of your valid official identification (INE, passport, or professional license).
Indication of the right you wish to exercise (Access, Rectification, Cancellation, or Opposition).

Arko will respond to your request within a maximum period of 20 business days from the date the complete ARCO Request is received. The response will indicate whether the request is applicable and, if so, it will become effective within the 15 business days following the date the response is communicated. The periods may be extended under the terms provided by the LFPDPPP.

VII. Revocation of Consent

You may revoke the consent that, where applicable, you have granted us for the processing of your personal data. However, it is important that you take into account that we will not be able to address your request or conclude the use immediately in all cases, as it is possible that due to a legal obligation we may need to continue processing your personal data. To revoke your consent, you must send a request to the email privacidad@arkomkt.com with the subject "Revocation of consent," indicating your full name and the personal data whose processing you wish to revoke.

VIII. Limitation of Use or Disclosure

If you wish to limit the use or disclosure of your personal data, you can send your request to the email privacidad@arkomkt.com with the subject "Limit use of data." If your request is applicable, we will register it on our exclusion list so that you do not receive commercial communications from us.

IX. Use of Cookies and Tracking Technologies

Arko reserves the right to make modifications or updates to this Privacy Notice at any time, to address legislative developments, internal policies, or new requirements for the provision or offering of our services. The modifications will be available on the website at the address arkomkt.com/aviso-de-privacidad. We recommend that you periodically review this Privacy Notice.

XII. Right to Appeal to INAI

If you consider that your right to the protection of personal data has been violated by any conduct or omission on our part, or you presume any violation of the provisions of the LFPDPPP, its Regulations, and other applicable ordinances, you may file your complaint or claim before the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI).
