By accessing and using the Arko website (the "Site"), as well as by providing your personal data through contact forms, advertising campaigns on third-party platforms (including Meta Ads), or any other means enabled on the Site, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please refrain from using the Site or providing your data.

Arko is a digital marketing and artificial intelligence agency offering communication, audiovisual production, design, web development, and AI consulting services for clients in Mexico and around the world. Through the Site, the Company presents information about its services, showcases completed projects, and allows users to express their interest in collaborating by submitting their contact details to request a quote or schedule a discovery call.

The information published on the Site, including service descriptions, scopes, estimated timelines, and project examples, is for informational purposes only and does not constitute a binding offer. The definitive conditions of any collaboration will be those set out in the corresponding proposal or contract.

4. Data Collection through Advertising Campaigns

Arko uses third-party advertising platforms, including Meta Ads (Facebook and Instagram), to promote its services and capture information from interested users ("leads"). By interacting with our ads and providing your personal data through the forms integrated into those platforms, you:

Grant your consent for Arko to collect, store, and use the information provided (name, email, phone number, and any other requested data) in order to contact you regarding our services.
Authorize Arko to communicate with you via phone, email, SMS, or messaging applications (including WhatsApp) to follow up on your request for information.
Acknowledge that your data will be processed in accordance with our Privacy Notice, which complies with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and its Regulations.

5. Use of the Website

By providing your contact details, whether through the Site, Meta Ads forms, or other channels enabled by Arko, you grant your consent to receive commercial communications related to the Company's services, including:

9. Applicable Law and Jurisdiction

These Terms & Conditions are governed by the laws in force in the United Mexican States. For their interpretation and fulfillment, the parties submit to the jurisdiction of the competent courts of Mexico City, Mexico, expressly waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.

10. Modifications to the Terms

Arko reserves the right to modify these Terms & Conditions at any time. Modifications will take effect upon their publication on the Site. The user is advised to periodically review this page to stay informed of any changes. Continued use of the Site after the publication of modifications constitutes acceptance of the updated terms.

11. Protection of Personal Data

The processing of your personal data is carried out in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP) and its Regulations.
